Customs and Constitutions – Draft closed for comment

Studies have indicated that customary laws and institutions are influential and effective in allocating natural resources and in settling disputes related to them. Nevertheless, customary law is often not taken into account in resource allocation and dispute resolution processes. “Customs and Constitutions: State recognition of customary law around the world” finds that customary law is recognized by constitution in more than 100 countries around the world. This study compiles baseline information on constitutional and statutory recognition of customary law, along with a bibliography of selected literature.
